Terms of Use

Using our service, you have expressed your acceptance of our Terms of Use ("ToU"), and agreed to be bound by the terms and conditions as described hereunder.

Registration
Prior the using of the Service of EPICI, you may register and provide true, accurate, current and complete information ("Registration Data") about yourself as prompted by the Registration Form.
You should maintain and promptly update the Registration Data to keep it true, accurate, current and complete.

Account
You are responsible for maintaining the confidentiality of the password and/or account, and are fully responsible for all activities that occur under your password and/or account. You agree to:
(a) notify EPICI of any unauthorized use of your password and/or account or any other breach of security, and
(b) ensure that you exit from your account at the end of each session. EPICI cannot and will not be liable for any loss or damage arising from your failure to comply with this security measure.

Contents
You also realize that by using the Service, you may be exposed to Content that is indecent, offensive, objectionable or otherwise unsuitable.
EPICI will NOT, in any circumstance or in any way, be liable for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the Service.

License for items purchased through EPICIstore
This license only applies to items purchased at EPICIstore.
This license may be updated from time to time and it is the Buyers responsibility to read and understand this license.

The original Author retains all copyrights, to the enclosed materials within this product file.
The Buyer is not purchasing the contents, only the right to use the contents.
The Buyer may not store it any place on a network or on the Internet where it may be referenced by a third party.
The Buyer may not redistribute the product file, without permission of the Author(s), either in whole or in part.
Buyer acquires the copyright to any derivative works, created using this product, provided none of the original product(s) materials can be extracted from the Buyer’s work by any means.
If the Author can show that any of the original material can be extracted from Buyer’s work, the Author may request that the Buyer’s work, and all copies thereof be deleted.
Refunds will be issued at the discretion of the EPICIstore staff.
All attempts will be made to solve the issue, including working with the Author(s) to ensure the issue is solved, before issuing a refund.
Refunds will be issued only after the Buyer has worked with the Author to fix the problem.
When a refund is issued, the Buyer is responsible for deleting all files using the product and may not distribute the product.

The Buyer is granted a non-exclusive, non-transferable license to use all of the contents of the encapsulated archive file.
The Author maintains that all items in the archive are their original work, or are derivative works from stuff found, and verified, to be in the public domain.
The Author maintains they legally possess the power to grant the Buyer this license for all enclosed materials.
The Buyer may use the materials in any commercial or non-commercial projects, as long as the Author’s product is protected from extraction and none of the items above have been violated.
Buyer may make a single backup copy of this archive file, for personal archival purposes only.
Buyer retains this license, even if the Author stops selling this product at a later date, or decides to change the price.
The Author may revoke this license, if it is shown that a Buyer has previously violated the terms and conditions above.

General practices regarding use and storage
You acknowledge that EPICI shall not responsible or be liable for the deletion or the failure to store any Content maintained, published or transmitted by the Service.
You also agree that EPICI reserves the right to change these general practices and limitations at any time, in its sole discretion, with or without prior notice.

Modifications of the service
EPICI reserves the right to modify or discontinue, temporarily or permanently, the Service, whole or parts, with or without prior notice, at any time.
You agree that EPICI shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.

Disclaimer of warranties
You agree that:
- you use the service at your own risk.
- the service is provided on an "as is" and/or "as available" basis.
EPICI expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to implied warranties of merchantability, non-infringement, and fitness for a particular purpose.
EPICI does not warrant that
(1) the service will satisfactorily meet your requirements,
(2) the service will be secure, uninterrupted, timely, or error-free,
(3) the acquired results from the use of the service will be accurate or reliable,
(4) the quality of any products, services, information, or other material purchased or obtained through the service by you will meet your expectations.
(5) any errors in the service will be corrected.
You will be solely responsible for any loss of data or damage to your computer that results from any material downloaded or otherwise obtained through the use of the service, which is done at your own discretion and risk.

Limitation of liability
you agree that in no event will EPICI be liable for any direct, indirect, incidental, special, consequential or exemplary damages whatsoever, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses, even if EPICI has been advised of the possibility of such damages, that result from:
(1) the use or the inability to use the service;
(2) the cost of obtaining of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the service;
(3) unauthorized access to or alteration of your transmissions or data;
(4) messages or conduct of any third party on the service; or other material purchased or obtained through the service by you will meet your expectations.
(5) any errors in the service will be corrected.

Various dispositions
The ToU and any disputes shall in all respects be exclusively governed by and interpreted in accordance with the laws of Italy (Rome).
Any dispute in contract or at law arising out of or in connection with the ToU that cannot be settled amicably shall be submitted to the competent court in Italy (Rome).
Without limit when affirmed previously, under no circumstances EPICI will be thought in charge of the lacked execution or of the delays derived directly or indirectly from natural events, strengthes or causes that go beyond the reasonable control, included and without limitations, the interruption of the Internet service, damage of computer equipments, damage of the equipments of telecommunication, they damage of other equipments, damage of the electricity grid, strikes, industrial dispute, revolts, insurrections, set fire, floods, storms, explosions, causes of greater strength, wars, interventions of the government, injunctions of national or international courts, the lacked execution performances by third parts.

Terms of use amendment
EPICI reserves the right to change the terms of this ToU with or without prior notice at any time.
